1. The Client shall bring proof that pet(s) are up to date on their vaccines. The Client assumes that pet(s) have no fleas or other diseases of any kind. If no proof that pet(s) are up to date, Hasen Photography reserves the right to cancel the session until proper proof is given. If Hasen Photography decides to cancel, the retainer will become credit until session is rescheduled along with proof of vaccines.
2. The client assumes all responsibility for their pet(s) or any other subjects during the session, including any and all destruction of personal, business or public property, personal injury or illegalities. Know your pet(s) and their behavior and limitations before allowing them to be photographed in your home or any public area. If your pet(s) should bite or harm another pet or person, or spread any illnesses to other pets, the Client will be responsible for any burdens occurred to the other party. Please disclose any behavioral or aggression issues before your session.
3. The Client understands that pets, when in groups, can accidentally injure each other while playing or swimming. Minor cuts, scrapes, bite wounds and bruises are a possible and not unexpected result of participation in group activities.
4. RETAINER AND PAYMENT: The Client shall pay the $50 retainer fee to retain the appointed date with Hasen Photography to perform the services specified herein for the selected session. The retainer fee is non-refundable. The session fee shall be paid in full during or before the event for the service to be provided. A la cart products shall be paid after photos have been edited, reviewed, and an order place.
5. CANCELLATION: If Client needs to cancel session they must give a 2-3 week notice or rescheduled on a case by case basis. Either email, phone, or use of contact page on website can be used to give notice. Retainer fee is non-refundable and will turn into credit for use on a later date. Any other payments like session fee or products that have been paid in advance will be refunded. If Client fails to notify Hasen Photography and or not show up for session any session fee or products that have been paid in advance will not be refunded.
6. Proof of photos shall have an email with link or through face to face interaction to the Client for approval. The client shall provide Hasen Photography with a written list of the changes and which photos are chosen from which final design of photo(s) are to be prepared, and another proof will be sent out for the final photos to be ordered after Client final approval. If there is excessive editing or Client wanting photos edited more than two times an editing charge will applied. See attached Price Schedule for available products that can be ordered.
7. The Client shall assist and cooperate with the Hasen Photography in obtaining the photographs, including but not limited to specifying pet(s) and/or scenes to be photographed with family; taking time to pose for photographs at the Photographer’s direction; providing a person to guide the Photographer to desired pet(s) and/or scenes; pre-shoot consultations, etc. The Photographer shall not be responsible for photographs not taken as a result of the Client’s failure to provide reasonable assistance or cooperation.
8. COPYRIGHT AND REPRODUCTIONS: Hasen Photography retains copyright of the all images, original and processed as sole property and hereby grants the Client unlimited but non-exclusive rights to use or reproduce the photographs for which the Client pays for selected photos. When purchased or provided to the client they are for personal use only. The client may NOT submit any photos taken by Hasen Photography for use in contests or commercial use. A written note for commercial use must be supplied and if doing so must give credit to Hasen Photography.
9. MARKETING: Hasen Photography retains the right to use the photographs for marketing, blog, website use and promotion purposes unless a written note from Client saying, “I would like to opt out of having the Photographer using the photographs for marketing, blog, website use and promotion”. Once notice is given to Hasen Photography, they will adhere to Clients wishes not to use the photos for marketing, blog, website use and promotion.
10. LIABILITY: If Hasen Photography cannot perform this contract due to act of God, illness, emergency, equipment failure, or other causes beyond the control of the photographer, and cannot be reschedule, Hasen Photography will return the client any money session fee or products paid but shall have no further liability in respect to the contract. The retainer is non-refundable and will count as credit if any of the above will occur. Hasen Photography shall not be held liable for loss or destruction of files, prints or products once they have been received by the client.
11. PRICING DISCLOSURE: The Client is aware that they have viewed the current price list for the session fees and any and all products, which may be found at http://hasenphotography.com/pet-photography/ on the website. The information on that page is subject to change without notice and is not legally binding in any way. Session fees and products are subject to sales tax. Session fee and product orders placed before pricing change will stay at the old pricing. Future session fee or products ordered after the pricing update will adhere to the new pricing.
12. TRAVEL: For locations over 25 miles a travel fee of $25 or more will be incurred based on how far the home or location is. Hasen Photography will discuss with Client if a travel fee will incur or not.
